The courts maybe, kinda, possibly agree with you but it would cost you a fortune in legal fees if H&F decided to fight the case. Parallel imports, H&F fought a case and won, this was as far as I can see overturned by the court of appeal.

Unless the Cuban government have a restriction on how many cigars you can bring back with you, what is to stop you flying there filling up your suitcase and getting the plane back, then going through the red channel at customs?.

In the Judgement of the court of appeal, the ruling was that HSA receive a 2% payment from the official shops in Cuba and that is enough to be taken as consent to allow parallel imports, if this incorrect then i cannot find a later judgement over that, as long as the limit of $25,000 is not exceeded in a single purchase.
It's going to be fun bringing ?15,000 of Cigars through the red channel at Heathrow




Mind I could always buy from NC sources and avoid all the hassle.
